MEDICAL MALPRACTICE

BIRTH INJURY - CEREBRAL PALSY

RESULT: $1,300,000.00 paid by defendant OB/GYN and Defendant Hospital.

FACTS: Mrs. A is the mother of Baby B. Baby B was delivered by Defendant OB/GYN. During Mrs. A's labor and delivery, the fetal monitor strips indicated that Baby B's heart rate was dangerously low. However, neither the Defendant nurse nor the defendant OB/GYN noted said bradycardia nor ordered an emergency C-Section. Instead, valuable time was lost by Defendants performing multiple attempts at vacuum extraction. Eventually, Baby B was delivered by a Cesarian section. Unfortunately, due to said negligence, Baby B suffered a hypoxic event (lack of oxygen to the brain), a brain bleed, and cerebral palsy.

PLAINTIFFS' CONTENTIONS:

Plaintiff contended that the failure of Defendants to perform a timely C-Section resulted in the child suffering brain injury and cerebral palsy.

DAMAGES: Baby B has been diagnosed with cerebral palsy and will require lifetime medical and special care needs for his cerebral palsy.

MEDICAL MALPRACTICE

ELDER ABUSE - NURSING HOME

RESULT: $375,000.00 paid by Defendant nursing home.

FACTS: Plaintiffs are the children of decedent Mrs. A. Mrs. A died as a result of aspiration pneumonia after suffering a choking incident at Defendant skilled nursing facility. While at Defendant nursing home, Mrs. A was evaluated and it was determined that she needed help with eating in that she needed assistance in cutting up her food. While eating hot dogs, Mrs. A suffered a choking incident, C.P.R. was not timely performed, 911 was not timely called, and she died as a result of aspiration pneumonia.

PLAINTIFFS' Mrs. A's death was due to the gross negligence of Defendant

CONTENTIONS: nurses and skilled nursing facility in failing to address Mrs. A's needs for eating assistance and choking hazards and failure to timely and properly intervene when she choked on her food.

DAMAGES: Death of Plaintiffs' mother
